Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Viralitea platform ("Service"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and have the authority to bind the organisation on whose behalf you are registering. By accepting these Terms you confirm that both conditions are met.
2. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at legal@viralitea.com if you suspect unauthorised access.
3. Acceptable use
You agree not to:
- Use the Service to violate any applicable law, regulation, or third-party right.
- Submit ad content or campaigns that are illegal, deceptive, or violate Meta's (or any other connected platform's) advertising policies.
- Attempt to circumvent, disable, or interfere with any security feature of the Service.
- Resell, sublicense, or make the Service available to third parties without our written consent.
- Probe, scan, or test the vulnerability of any Viralitea system or network.
4. AI-generated outputs
The Service uses AI to generate recommendations, creative copy, and campaign actions. You acknowledge that:
- AI outputs are suggestions, not professional advice. All final decisions, including budget allocation and ad approvals, remain your responsibility.
- You must review autonomous actions executed under the "Guarded" and "Autopilot" autonomy levels before relying on them for business decisions.
- Viralitea is not liable for outcomes arising from ad spend decisions made or executed via the platform.
5. Connected accounts
By connecting a Meta (or other platform) ad account you authorise Viralitea to read data and, depending on your autonomy level, make changes on your behalf. You are solely responsible for ensuring you have the rights to grant this access and for monitoring all changes made through the platform.
6. Intellectual property
The Service and all related software, designs, and documentation are the exclusive property of Viralitea Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the Service during the term of your subscription. You retain ownership of your data and ad creatives.
7. Subscriptions and billing
Pricing and billing terms are set out in your order form or the applicable plan page. Subscriptions automatically renew at the end of each billing period unless cancelled. Refunds are not issued for partial billing periods.
8. Limitation of liability
To the maximum extent permitted by law, Viralitea's total aggregate liability for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the fees paid by you in the three months before the event giving rise to the claim, or (b) USD $100. In no event shall Viralitea be liable for lost profits, data loss, or indirect or consequential damages.
9. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Termination
Either party may terminate these Terms at any time by giving written notice. Viralitea may suspend or terminate your account immediately for material breach of these Terms. Upon termination, your access to the Service will cease and your data will be deleted in accordance with our Privacy Policy.
11. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes
We may update these Terms from time to time. We will give you at least 14 days' notice by email before material changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
